I.   INTRODUCTION

Central Oregon Community College is committed to the prevention of illicit drug use and the abuse of alcohol by both students and employees.  Drug and alcohol abuse is a significant public health problem which has spread throughout our society, affecting performance and productivity, as well as our level of general health.  In addition, the use of drugs can adversely affect an organization's level of safety as well as its public confidence and trust.  And lastly, with reference to "The Drug-Free Schools and Communities Act Amendment of 1989 (Public Law 101-226)",

"...no institution of higher education shall be eligible to receive funds or any other form of financial assistance under any Federal program, including participation in any federally funded or guaranteed student loan program, unless it certifies to the Secretary that it has adopted and has implemented a program to prevent the use of illicit drugs and the abuse of alcohol by students and employees..."

In brief, this information packet has been developed by Central Oregon Community College to comply with the current federal law and to educate and inform its students and employees of the health risks, counseling and treatment resources, and sanctions for noncompliance.  Central Oregon Community College will biennially review this program to ensure that the sanctions required are consistently enforced.

II.   STANDARDS OF CONDUCT

STUDENTS AND EMPLOYEES

In compliance with the Drug-Free Workplace Act of 1988 (Public Law 100-690), Title V, Subtitle D) and the Drug-Free Schools and Committees Act Amendment of 1989 ( Public Law 101-226), it shall be the policy of Central Oregon Community College to maintain a drug-free campus for all employees and students.  In accordance with this intent, the policy  G-70, Drug Free Campus and HR-1-1 Standard of Conduct for College Employees is in effect.

Drug-Free Campus.  The unlawful possessions, use or distribution of illicit drugs and alcohol is prohibited on the College campus, in all College facilities, or as part of any College-sponsored activity.  Violators of this policy will be prosecuted to the full extent of State and Federal law and, in addition, there are specific consequences for employees and for students which are stated in the College Drug-Free Campus Procedures.

The provisions of this policy regarding the prohibited dispensing, possession of, or use of alcoholic liquor may be suspended temporarily by action by the President in accordance with College Policy G-2-0, Alcoholic Beverages (COCC Procedures Manual).

             Alcohol is an illegal drug for those under age 21.  Oregon statutes forbid any person other than the minor’s parent or guardian to sell, give or otherwise make available alcoholic beverages to a person less than twenty-one years of age.  Also it is unlawful to sell, give or otherwise make available alcoholic beverages to anyone when you know they will make the alcohol available to minors. Misrepresenting one’s age for purpose of obtaining alcoholic beverages is a Class  C misdemeanor.  For drivers under 21, ANY detectable amount of alcohol may be grounds for license suspension from 90 days to one year.

            Most drugs are illegal, and a criminal conviction may bar a student from one’s chosen career path or an employee from employment with the College.

 V.   CENTRAL OREGON COMMUNITY SANCTIONS

             STUDENTS

            Students who violate either the drug or alcohol policies will follow the disciplinary procedures outlined in the Student Rights and Responsibilities.  These procedures provide for due process for the student.  Those found guilty of misconduct will be subject to the Forms of Discipline/Penalties as stated in the Student Rights and Responsibilities.  These may include reprimand, disciplinary probation, summary suspension (immediate removal from presence on campus and participation in any College activity); suspension (exclusion from classes, privileges or activities for a specified period); and expulsion (termination of student status).  Following a disciplinary review, if student is found guilty and not expelled, one of the forms of disicplines/penalties may be imposed in combination with a requirement to complete a drug or alcohol treatment and rehabilitation program.

 

            EMPLOYEES

            Sanctions which may be imposed on a College employee for violation of the code are outlined in HR-1-1 Standard of Conduct for College Employees in the College Procedures Manual: 

                Requirement of satisfactory completion of a drug abuse assistance or rehabilitation program; disciplinary probation (the suspension of a more severe penalty for a specific time period, based upon good behavior); suspension (the temporary barring from employment for a specific time period, without pay); and/or termination (to sever employment with the College).

All employees shall notify the Director of Human Resources within five days of their conviction for a violation of criminal alcohol drug laws involving the workplace.

VI.   ASSISTANCE PROGRAMS AVAILABLE TO STUDENTS AND EMPLOYEES

        Students seeking referral assistance in connection with alcohol or drug-related problems may contact their academic advisor, the Counseling Department, ext. 7580, the Office of Student Life, ext 7590, and/or the Campus Health Services, ext. 7586. 

         Employees seeking assistance for chemical/alcohol dependency may contact their immediate supervisor/or the Office of Human Resources.   An explanation of benefits available to employees for chemical and alcohol dependency is contained in both the Employee Assistance Program brochure and the Oregon School Personnel Employee Benefit Plan (Plan 1).   These documents are automatically provided to all employees.  Additional copies are available in the Office of Human Resources.
